IMPORTANT – PLEASE READ CAREFULLY
This End-User License Agreement (“Agreement”) is a legal contract between you (either as an individual or as an entity) and GEC srl for the use of the Aqua Map software application, including any updates, subscription-based services, map data, documentation, and associated media (now on “Software” or “Application”).
By downloading, installing, or using the Software, you agree to be bound by the terms of this Agreement.
Your use of the account, online and offline services, and all features accessible through the Application is also governed by the Terms of Use, which are hereby incorporated by reference into this Agreement.
If you do not agree to the terms, do not install or use the Software.
1. License grant
Aqua Map grants you a limited, non-exclusive, non-transferable, and revocable license to use the Software solely for your legitimate personal or professional purposes in accordance with the terms of this Agreement.
1.1. Restrictions
You may not:
- reverse engineer, decompile, disassemble, decrypt, or otherwise attempt to derive the source code of the Software;
- modify, adapt, translate, or create derivative works based on the Software;
- sell, rent, sublicense, distribute, or otherwise transfer the Software to third parties;
- bypass copy protection, rights management systems, or security measures, or remove copyright notices from the licensed materials;

use the Content on
- more than five mobile devices at the same time,
- beyond limits imposed by security measures, or
- beyond what is allowed by the rights holders;
- use the Software for illegal purposes or in violation of any applicable laws or regulations.
1.2. Additional limitations on licensed materials
Licensed materials are provided for informational purposes only and should not be relied upon in situations where personal safety or life is at risk. Only official publications such as government charts and notices to mariners provide all the necessary information for safe navigation.
Users are expected to use such materials with care and awareness, avoiding behavior that may cause harm, danger, obstruction, or discomfort to themselves or others.
ANY ROUTE OR TRACK, GENERATED THROUGH THE SOFTWARE OR ANY OTHER APPLICATION, IS A PRELIMINARY SUGGESTION USEFUL FOR PLANNING AND MUST NOT BE USED FOR DIRECT NAVIGATION.
The Licensor urges users to strictly comply with applicable regulations, including speed limits and other restrictions, and to always act responsibly, cautiously, and attentively while using the Application.
2. Intellectual property
The Software is the exclusive property of GEC srl or its licensors and is protected by copyright, trademark, and other intellectual property laws. This license does not grant you any ownership rights in the Software or its contents (including maps, data, and features).
3. Updates and modifications
GEC srl may, at its sole discretion, provide updates, improvements, and bug fixes to the Software. Such updates will be subject to this Agreement unless otherwise stated. Continued use of the Software after an update indicates acceptance of the updated terms.
4. Data and online services
Certain features of the Software require an internet connection and/or an active subscription. Access to advanced features may be subject to subscription fees.
4.1. Third-party data
The Software may include or access data provided by third parties. GEC srl does not guarantee the accuracy, completeness, or timeliness of such data and shall not be liable for any losses resulting from reliance on such data.
5. Limitation of liability
The Software is provided “as is” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
In no event shall GEC srl be liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use the Software, including data loss, financial loss, or damage to persons or property, even in marine environments.
6. Subscription terms and renewals
Access to advanced features of the Software may be subject to regional subscription plans. Unless canceled, subscriptions automatically renew for the next billing period. Terms regarding pricing, duration, renewal, and cancellation are available in the “Store” section of the app.
7. Termination
This Agreement remains in effect until terminated. You may terminate it at any time by uninstalling the Software. Aqua Map reserves the right to suspend or terminate your license in case of a breach of the terms. Upon termination, you must cease all use of the Software.
8. Privacy
Use of the Software is subject to our Privacy Policy, which explains how we collect, use, and protect your data. The policy is available here.
9. Governing law and jurisdiction
This Agreement is governed by the laws of Italy. Any disputes arising from or relating to this Agreement shall be subject to the exclusive jurisdiction of the Court of Lucca, unless otherwise required by law.
10. Final clauses
If any provision of this Agreement is found to be invalid, the remaining provisions shall remain in full force and effect. The failure of GEC srl to enforce any right or provision shall not constitute a waiver of such right or provision.
Acceptance
By installing or using the Software, you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety.
